At corporate conferences, around the water cooler, on the internet — the talk among contractors is that 2007 was a good year. New construction starts, excluding residential construction, for the first 10 months of 2007, increased 4 percent compared to the prior year. In addition, according to McGraw-Hill, construction for 2007 nonresidential building should be able to register its fifth straight year of expansion when viewed in current dollar terms.

For at least fifty years, the construction industry has struggled with the issue of contingent payment clauses in form contracts. Contingent payment clauses are usually subcontract provisions conditioning a general contractor´s obligation to pay its subcontractors on prior receipt of payment from project owners.
